When can the bare rent be increased?

There are two cases in which the rent can be increased:

  • Once a year the bare rent may be increased. The maximum rent increase is determined annually by law on the basis of the average inflation in recent years. The rent increase also depends on the level of the rent in relation to the maximum basic rent. Because of the rent increase, the rent may never exceed the maximum bare rent.
  • If the landlord makes an improvement to the living space (for example, a new installed kitchen) can be agreed that this leads to a rent increase. This must always be done in consultation; the tenant always has the right to refuse the improvement, and thus the price increase.

A rent increase must always be made in writing and at least two months in advance.
